Terms & Conditions

1. Introduction

These Terms and Conditions govern your use of ekaanwellness.com and the membership services provided by Ekaan Wellness Private Limited ("Ekaan", "We", "Us", "Our"). By accessing our website or enrolling in any membership plan, you agree to be bound by these terms. If you are enrolling on behalf of a senior family member, you confirm that you have the authority to do so.

2. Membership

  • Membership plans are available to individuals residing in Delhi NCR. Ekaan Wellness reserves the right to decline any membership application at its sole discretion.
  • Membership begins on the Service Activation Date, which is confirmed within 48 hours of payment. You will receive written confirmation of activation.
  • Memberships are billed quarterly in advance. Taxes are charged at actuals.
  • Ekaan Wellness reserves the right to revise plan inclusions or pricing with reasonable prior notice.
  • Membership rights and benefits are personal and non-transferable.
  • If the member is unable to consent due to age or medical condition, all obligations and responsibilities shall rest with the Next of Kin ("NOK") — a family member of sound mind, above 18 years of age, authorised to act on the member's behalf.

3. Services

  • Services are delivered within Delhi NCR at the member's registered residential address ("Home Zone").
  • If services are required outside the Home Zone, Ekaan Wellness must be notified at least 48 hours in advance. Services outside the Home Zone are subject to availability and confirmation.
  • Our Care Managers and partner professionals require reasonable access to the member's home to deliver services. If access is unavailable, Ekaan Wellness shall not be held responsible for any delay or inability to render services.
  • Ekaan Wellness is not a medical institution. Our services include concierge coordination, companionship, wellness support, and daily life assistance. Medical diagnosis and treatment remain the responsibility of registered medical professionals.
  • Services are subject to force majeure conditions including acts of God, pandemic, strikes, civic disruptions, or any other circumstances beyond our control. Such events shall not constitute a breach on our part.

4. Member Responsibilities

  • Members and their NOK must provide accurate, complete, and updated information including medical history, emergency contacts, and residential details.
  • Members must ensure that Ekaan Wellness team members are treated with dignity and respect at all times. Any misconduct, harassment, or physical harm directed toward our team will result in immediate termination of membership.
  • Members shall not attempt to directly hire, engage, or solicit any Care Manager, partner, or vendor introduced by Ekaan Wellness during the membership period or within 12 months following its expiry.
  • The safety and security of Ekaan's direct employees and corporate personnel, including Care Managers, relationship managers, auditors, or authorized representatives, while on the member's premises shall be the responsibility of the member. Independent third-party personnel, including caregivers, attendants, nurses, therapists, technicians, maintenance personnel, or other partner personnel deployed by independent service providers, shall remain subject to the employment, supervision, safety, insurance, and liability arrangements of their respective employers or service providers.

5. Payment

  • Membership fees are payable in advance for the selected billing period.
  • Any additional services availed beyond the membership plan will be charged at prevailing rates and must be settled within 7 days of invoice.
  • If any costs or expenses are incurred by Ekaan Wellness while rendering services on behalf of the member, these shall be reimbursed by the member within 7 days of the invoice being raised.

6. Termination by Ekaan Wellness

  • Ekaan Wellness may terminate the membership by giving 7 days written notice, with or without cause.
  • Ekaan Wellness may terminate the membership immediately if the member or NOK is found to have provided false or incomplete information, breached these terms, or engaged in misconduct toward our team.
  • Ekaan Wellness reserves the right to decline or discontinue services if a member or any person at the member's residence is suffering from a communicable disease that was not disclosed at the time of enrolment.

7. Termination by Member

  • A member may terminate their membership at any time by providing written notice to care@ekaanwellness.com.
  • Upon termination, Ekaan Wellness shall retain the fee for the current quarter in which services were rendered. Any remaining balance for future quarters will be refunded subject to deductions, as per the Refund Policy.

8. Cessation of Membership

  • Non-renewal: Membership will cease upon expiry of the current term if not renewed.
  • Death: Membership terminates automatically upon the death of the member. Fees are payable up to the date services were last rendered.

9. Limitation of Liability

  • Ekaan Wellness will make every reasonable effort to deliver services with care and skill. However, we cannot be held liable for any direct, indirect, or consequential damages arising from the use of our services or the conduct of independent third-party service providers.
  • In the event of any liability, our responsibility shall be limited to the membership fee paid for the quarter in which the liability arose, after deducting the value of services already rendered.

10. Third-Party Services

Ekaan Wellness coordinates third-party services — including medical, diagnostic, home maintenance, and wellness services — on behalf of members. We are not responsible for the conduct, quality, or outcomes of independent third-party providers. Any direct engagement between the member and a third-party provider is at the member's own risk.

Independent third-party providers are solely responsible for their personnel, service quality, professional conduct, operational performance, staffing decisions, supervision, licensing, insurance, negligence, omissions, and service outcomes.

Ekaan's role is limited to coordination, facilitation, communication, reporting, and support.

11. Intellectual Property

All content on ekaanwellness.com including text, design, and brand assets is the property of Ekaan Wellness Private Limited and may not be reproduced without prior written permission.

12. Modifications

Ekaan Wellness reserves the right to update these Terms and Conditions at any time. Updated terms will be posted on the website. Continued use of services constitutes acceptance of the revised terms.

13. Governing Law

These Terms and Conditions are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in New Delhi.
